Nigerian lawyer, Femi Falana, has said the Academic Staff Union of Universities will appeal a court ruling ordering the aggrieved union to end its seven-month long strike on Friday, September 23.
According to the Human rights activist representing ASUU in the ongoing case with Federal Government, the appeal was supposed to have been filed yesterday, Thursday.
Falana who made this announcement on Channels TV Sunrise Daily on Friday said the appeal was not filled yesterday because they could not get hold of the original order of the National Industrial Industrial court asking the striking varsity members to return to classes.
The National Industrial Court had ordered ASUU to call off their seven-month-old strike and resume classes.
Reacting to the order, Falana while fielding questions from newshounds said the National Industrial Industrial court ought to resolve for settlement rather than give an order.
However, since his client, ASUU has expressed dissatisfaction at the ruling of the Industrial Court, they have decided to file an appeal in court today, Friday.
He said, “The chairman of the pro-chancellors has come out to say this order will not help, the students have rejected the invention of the court, ASUU has rejected the intervention of the court but for us as lawyers, our duty is to advise our clients in line with the provisions of the law.
“And I have made it clear to the ASUU, your choice is to file an appeal if you’re dissatisfied, and the lecturers are dissatisfied, we are filing an appeal this morning. It should have been filed yesterday, but unfortunately, we didn’t get the certified true copy of the ruling that circulated two days ago until about 3 PM yesterday.
“So, we are filing an appeal against the ruling of the court together with a motion of stay of execution, in other words, suspending the operation of the order until the appeal is determined.”
