Suspended Central Bank of Nigeria governor, Godwin Emefiele has asked a Federal High Court Sitting in Lagos to halt the federal government’s prosecution of him on the accusation of illegally fireman possessing.
According to Channels, Emefiele is additionally pursuing a court judgement to absolve him of all charges brought forth by the Government, which has demonstrated a flagrant disregard for the existing court rulings granting him bail on July 25, 2023.
Emefiele additionally requested a supplementary injunction to prevent the Federal Government from receiving any sort of leniency from the judiciary, until it adheres to the conditions outlined in the bail judgement.
The suspended CBN Governor, represented by solicitors under the direction of Senior Advocate of Nigeria Joseph Daudu, made this request before Vacation Judge Justice Nicholas Oweibo, who had granted him bail following his arraignment.
In accordance with Section 6(6)(a) of the 1999 Constitution (as amended), pertinent provisions of the Administration of Criminal Justice Act, 2015, and the inherent powers of the court, the application was filed.
In order to force the government and the DSS to comply with the court’s order granting him bail or remanding him in the custody of the Nigerian Correctional Centre until he completes the terms of his bail, Emefiele asked Justice Oweibo to halt further proceedings in the current charge.
A Senior Advocate of Nigeria and member of the defence team, Victor Opara, has verified that the application, submitted on August 8th, has been duly served on the Federal Government today.
The purpose of the application is to claim the court’s jurisdiction in order to implement its orders, so avoiding the perception of being ineffectual or without authority.
The applicant further asserts that the process aims to uphold and safeguard the effectiveness, grandeur, and soundness of the court, alongside the principles of the rule of law inside our democratic system.
