A Federal High Court in Abuja has thrown out a lawsuit filed by Phillips Shaibu, the impeached deputy governor of Edo State, challenging the outcome of the Peoples Democratic Party governorship primary election held on February 22.
According to The PUNCH, the court ruled that Shaibu lacked the legal standing to contest the primary’s outcome since he did not fully participate in it and was absent from the venue on the day of the election.
In his judgment, Justice James Omotosho stated that Shaibu’s lawsuit was premature, as he failed to exhaust the PDP’s internal dispute resolution mechanisms before seeking legal action.
The judge emphasized that as a party member, Shaibu was obligated to follow the PDP’s rules and regulations, which require an aggrieved aspirant to approach the party’s Appeal Committee before filing a lawsuit.
He stated that there was sufficient evidence indicating Ighodalo’s victory in the primary.
