The Academic Staff Union of Nigeria on Tuesday, lost in its bid to prevent the Congress Of University Academics and the Nigeria Association of Medical and Dental Academics, as trade unions by the Federal Government.
The National Industrial Court sitting in Abuja dismissed the suit filed by the ASUU, challenging the registration of NAMDA and CONUA, both as Trade unions in Nigeria.
Delivering judgement, Justice Benedict Kanyip, on Tuesday, July 25, 2023, declared that Section 27 of the Trade Union Act allows for more than one trade union in employment.
The court also held that ASUU did not present evidence to show that CONUA and NAMDA were fully registered when it filed the suit.
Similarly, the court further held that ASUU committed an error by filing against NAMDA as the National Association of Medical and Dental Academics, instead of the Nigeria Association of Medical and Dental Academics.
However, Justice Kanyip affirmed that NAMDA was not in existence at the time ASUU filed the suit.
All reliefs sought by ASUU were refused, and the suit was however dismissed by the court.
